I have also seen it spawn with Reinforcement Wave 1, and also seen it spawn not at all. It could possibly be on a timer, as the variety of ways I've seen it spawn implies that however you do the anomaly, there is a chance.
Additionally, an active tengu (with the augmented capacitor reservoir subsys, not the recharge subsys) may struggle with this anomaly thanks to the 4x neut's on the first spawn. I occasionally have to warp out after killing some of the cruisers. This issue can be avoided either if you have better cap management skills (mine are NOT perfect) or if you shoot the Upholder's first from 80km off.
